Terms and conditions of sale

The maisonguermont.com website (hereinafter the “Site”) is published by Milène Guermont.

Milène Guermont is a sculptor and sells books and printed works presented and sold on the Site (hereinafter the “Products”). The Products available for sale are those presented on the Site, published in limited editions of 50 copies.

These terms and conditions of sale apply to any order of one or more Products by any person using the Site (hereinafter the “Customer”). Each work is offered framed, with no warranty on the frame.

These terms and conditions of sale are permanently available on the Site and the Customer acknowledges having read them before placing an order and having accepted all of their terms without reservation.

1 — Orders

Orders are placed exclusively on the maisonguermont.com Site. To place an order, the Customer must create an account providing the following mandatory information: surname, first name, email address, home address and mobile phone number.

A summary of the selected order is sent to the Customer, who must then log in and enter their address so that the applicable shipping costs can be indicated. After accepting the order, the Customer is redirected to a payment process managed by PayPal, or to the information required for a bank transfer. Placing the order obliges the Customer to pay for it immediately.

Any order accepted by the Customer constitutes a contract of sale and acceptance of all the contractual provisions set out in these terms and conditions of sale.

2 — Prices and payment terms

On the Site, prices are shown in euros, all taxes included for delivery in France, excluding customs clearance costs and financial charges relating to payment (repatriation and exchange fees relating to bank transfers). Shipping costs are calculated when the order is placed. The Customer acknowledges being informed that, for orders from a country outside mainland France, all additional duties and taxes are payable by the Customer.

The price must be paid by the Customer when the order is placed. Payment is made to PayPal via the Site or by bank transfer.

3 — Delivery

The Products ordered are shipped to the address given by the Customer when ordering. The Customer must ensure that the information provided is accurate and complete (street number, building number, access code, telephone number). Shipping costs are a flat rate, whatever the delivery address.

The average delivery time in France is 5 to 10 working days. Orders are shipped by La Poste via Colissimo, a tracked delivery service without signature on receipt. If the Customer is absent, a delivery notice allows the Products to be collected from the nearest post office within the period indicated by the postal services.

Delivery times are given as an indication only and Milène Guermont cannot under any circumstances be held liable for a delay in delivery caused by an external event.

4 — Retention of title

Milène Guermont retains full ownership of the Products sold until the price has been paid in full, including principal, costs and taxes.

5 — Right of withdrawal, returns and exchanges

In accordance with applicable law (articles L.221-18 et seq. of the French Consumer Code), the Customer has a legal period of 14 clear days from receipt of the order to exercise the right of withdrawal, without justification and without penalty or additional charges.

To exercise this right, the Customer must send the withdrawal form provided with the order, under the conditions specified on that form. The Customer must also return the Product(s) using the carrier of their choice, at their own expense, within 14 working days (as evidenced by the postmark or carrier receipt), enclosing the delivery note and any customs documents.

Whether the whole order or only part of it is returned, only the price of the Products purchased is refunded; return costs remain payable by the Customer. The refund is made within 14 days to the bank account used to pay for the order.

6 — Warranty and liability

The statutory warranties of conformity provided for by the French Consumer Code (in particular articles L.217-3 and L.217-5) apply to the Customer. The seller delivers goods that conform to the contract and is liable for defects in conformity existing at the time of delivery that appear within two years of that delivery.

No warranty is given as to the quality, condition or durability of the frame of the work.

7 — Data protection

The Customer is informed that personal data concerning them is collected and processed by Milène Guermont when the account is created and each time an order is placed on the Site. This data is processed and stored in compliance with French law n° 78-17 of 6 January 1978 on data processing and freedoms.

The Customer may access their personal data in order to request its modification or deletion, by writing to contact@mileneguermont.com with the subject “MODIFICATION DE DONNÉES”.

8 — Intellectual property

Milène Guermont owns all intellectual property rights over all the elements that visually and technically make up the Site, including software, code, developments, graphic design, logos, concepts, the database (structure and content) and the related trademarks, whether registered or not.

The Customer acknowledges acquiring no intellectual property rights over these elements and expressly undertakes not to use them for any purpose other than browsing the Site and ordering Products.

9 — General provisions

Milène Guermont reserves the right to adapt or amend these terms and conditions of sale at any time. The version in force is the one available on the Site on the day the Customer places an order.

If one or more provisions of these terms were to be declared void, the remaining provisions would retain their full force and effect.

Any claim or dispute relating to use of the Site must be sent in writing to contact@mileneguermont.com with the subject “RÉCLAMATION”. These terms and conditions of sale are governed by French law and the language of the contract is French.
